Dubai: Two brothers lost their appeal on Sunday and will be jailed for life for intentionally killing a businessman in the underground parking of a shopping mall over a Dh1 million dodgy business deal.
The 19-year-old Afghan and his brother, 23, visited the Pakistani businessman at his office in Naif to discuss a business deal to become partners in managing a parking facility in October 2017.

After four days of business meetings and discussions, the brothers visited the businessman at his office and took him by car to the mall where the 23-year-old brother had a tailoring shop.
After having a heated argument while driving around the city, the Afghans blamed the Pakistani for the delay in concluding the business agreement even though they had paid him Dh1 million in advance.
Once they drove the car into the mall’s underground parking, one of the brothers dragged out a knife from the door’s pocket and tried to stab the businessman, who opened the door and jumped.


The brothers ran behind the businessman, who dodged the attacks by running between the cars until he was stabbed repeatedly in the chest and head and killed.
In April, the Dubai Court of First Instance jailed the 19-year-old defendant for 15 years and acquitted the 23-year-old brother citing lack of corroborated evidence.
Prosecutors appealed the primary judgement before the Appeal Court and sought to overturn the brothers’ punishments.
The younger brother also appealed and sought to be acquitted.
On Sunday, presiding judge Eisa Al Sharif overturned the 23-year-old defendant’s acquittal and the 15-year imprisonment of the 19-year-old.
“The court has unanimously agreed to overturn the primary judgement and jailed the defendants for life,” said presiding judge Al Sharif in courtroom 20.
The duo, who had pleaded not guilty, will be deported following the completion of their punishments.
Records said the mall’s security guards, who saw the knife attack on the CCTV, rushed to the aid of the businessman. The guards saw the brothers trying to pull the businessman into the trunk of their sports utility vehicle. Upon seeing the guards, the brothers jumped into the vehicle and drove off.
On-site investigation exposed that the car was registered in the name of a Pakistani who, according to immigration records, was out of town at that time.
A guard informed the police that the 23-year-old Afghan [who was seen on the CCTV footage] owned a tailoring shop on the mall’s first floor.
Police raided the brothers’ residence in Sharjah and found a ghotra (headdress) that was used in the attack. The ghotra had the victim’s bloodstains, said records.
The Afghan brothers fled to Al Ain from where they were planning to flee the country.
A police captain said an informant alerted them that the brothers were hiding in Al Ain.
“We identified the defendants from the car plate number and the trade licence of the tailoring shop. We arrested them shortly before they absconded from Al Ain. During questioning, they claimed that they had been victims of a Pakistani hoodwinker who swindled their Dh1 million which they had invested in a business partnership,” the captain said.
Sunday’s ruling remains subject to appeal before the Cassation Court.
